Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Cyber Spark Portal application operated by CyberSpark(“we”, “our”, or “us”). By accessing or using the application you agree to be bound by these Terms. If you do not agree, you may not use the application.

1. Description of Service

Cyber Spark Portal is a team productivity and project-management portal designed for use by organizations and their employees. The application provides features including activity tracking, leave management, calendar and meeting integration (Google Workspace, Microsoft Teams), git repository data syncing (GitHub), and administrative reporting.

2. Eligibility and Accounts

To use Cyber Spark Portal you must:

• Be at least 18 years of age.
• Be a current employee, contractor, or authorized member of an organization that has been granted access by CyberSpark.
• Provide accurate and complete information when creating your account and keep it up to date.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at info@cyberspark.in if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

• Use the application for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
• Attempt to gain unauthorized access to any part of the application, its servers, or related systems.
• Reverse-engineer, decompile, or disassemble any part of the application.
• Submit false, misleading, or fraudulent activity, leave, or time-tracking data.
• Interfere with or disrupt the integrity or performance of the application or its underlying infrastructure.
• Use automated bots or scripts to access the application without express written permission.

4. Third-Party Integrations

Cyber Spark Portal integrates with third-party services including Google Workspace, Microsoft Teams, and GitHub. By connecting these integrations, you agree to the respective terms of service and privacy policies of those providers. We are not responsible for the content, policies, or practices of third-party services. You may revoke any integration at any time from within the application settings.

5. Data and Privacy

Your use of the application is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the application, you consent to the collection and use of information as described in the Privacy Policy.

6. Intellectual Property

All content, features, and functionality of Cyber Spark Portal — including but not limited to software code, design, logos, and text — are owned by CyberSparkor its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application solely for your organization's internal business purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Organizational Administrators

If you access the application as an administrator on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. The organization is responsible for ensuring that all users within the organization comply with these Terms and for all actions taken by its users.

8. Disclaimers

THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERSPARK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOUR ORGANIZATION TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your access to the application at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the application ceases immediately. Provisions that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the “Last updated” date at the top of this page. Your continued use of the application after changes take effect constitutes your acceptance of the revised Terms.
